Subject to applicable UK consumer protection law, Trackpro’s total liability for any and all claims arising under these Terms will not exceed the total amount of fees you have paid to Trackpro in the six (6) months immediately preceding the event giving rise to the claim, or one hundred pounds sterling (£100) if no such payments have been made.

If you are acting as a consumer (rather than a business), nothing in these Terms shall limit or exclude Trackpro’s liability for breach of your statutory rights, including any liability for death or personal injury caused by Trackpro’s negligence.

13. Suspension and Termination

Upon termination, your right to access the Services ceases immediately. Trackpro may, at its sole discretion, delete or anonymise any User Content or data associated with your Account. Provisions of these Terms that by their nature should survive termination will remain in effect.

These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales.

These Terms (together with our Privacy Policy and any other documents expressly referenced) constitute the entire agreement between you and Trackpro regarding the subject matter. They supersede any prior agreements or understandings.

15.2 Severability

A delay or failure to exercise or enforce any right under these Terms does not constitute a waiver of that or any other right.

These Terms do not create any third-party beneficiary rights, except where expressly stated otherwise.

Trackpro shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond its reasonable control (e.g., natural disasters, strikes, wars, riots, government actions).
